PUBLIC OFFER

This document is an official, public and irrevocable offer (Offer) of the JustBuy store (hereinafter referred to as the “Seller”) to conclude a contract for the purchase and sale of goods remotely through the justbuy.com.ua online store (hereinafter referred to as the “Site”) with any individual or legal entity (hereinafter referred to as the “Buyer”) on the terms specified in this Offer.

1. DEFINITION OF TERMS

1.1. Public offer (Offer) is an offer of the Seller, addressed to an unlimited number of persons, to conclude a Contract for the purchase and sale of Goods on certain terms.

1.2. Online store (Site) is the Seller’s website, which is a means of presenting and selling Goods.

1.3. Seller – a business entity that sells the Goods presented on the Site.

1.4. Buyer – any capable individual, legal entity or individual entrepreneur who has accepted a public offer.

1.5. Goods – a list of product names presented on the Site.

1.6. Order – a properly executed application by the Buyer to purchase the Goods selected by him, placed through the functionality of the Site or by telephone.

1.7. Acceptance – the Buyer’s full and unconditional consent to the terms of this Offer. Acceptance is the fact of the Buyer placing an Order on the Site.

2. SUBJECT OF THE AGREEMENT

2.1. The Seller undertakes to transfer the Goods to the Buyer’s ownership, and the Buyer undertakes to pay for and accept the Goods on the terms set out in this Agreement.

2.2. The ownership of the ordered Goods shall be transferred to the Buyer from the moment of actual transfer of the Goods and full payment of its cost.

3. ORDER PLACEMENT PROCEDURE

3.1. The Buyer independently places the Order on the Site by adding the selected Goods to the "Cart" and filling out the electronic Order form, or places the Order by phone.

3.2. When placing the Order, the Buyer undertakes to provide complete and accurate information necessary for its execution (full name, contact phone number, e-mail, delivery address). In the case of placing the Order with payment on credit, in installments or under other conditions, the Buyer's RNOKPP and date of birth shall be additionally indicated.

3.3. After placing the Order, the Seller's representative may additionally contact the Buyer to confirm the Order, clarify the details and terms of payment and delivery.

4. PRICE OF GOODS AND PAYMENT PROCEDURE

4.1. Prices for Goods are determined by the Seller and indicated on the Site. Prices may be changed unilaterally by the Seller. The price of the ordered Goods for which an Acceptance has already been issued is not subject to change.

4.2. Payment methods: The Buyer may make payment by the following methods:

- Non-cash payment (LiqPay, MonoPay, etc.);

- Payment upon receipt (postpay / cash on delivery);

- Payment in cash upon pickup / courier;

- Payment in installments or on credit.

4.3. When paying for the Goods, the Buyer undertakes to comply with the conditions established by financial intermediaries (banks / payment systems).

5. DELIVERY OF GOODS

5.1. Delivery is carried out by carriers on the territory of Ukraine, with the exception of temporarily occupied territories and combat zones.

5.2. The cost of delivery is paid by the Buyer in accordance with the carrier's tariffs, unless otherwise stipulated by the Seller separately (for example, the "Free Delivery" promotion).

5.3. Delivery times are determined by the carrier. The Seller makes every effort to ship the Goods within 1-3 business days from the moment of confirmation of the Order (or from the moment of crediting the payment, if it is an advance payment).

5.4. The risk of accidental loss or damage to the Goods passes to the Buyer from the moment of transfer of the Goods to the carrier.

6. WARRANTY, RETURNS AND EXCHANGES

6.1. Goods that have a warranty period established by the manufacturer are provided with an appropriate warranty.

6.2. The Buyer has the right to exchange or return the Goods of proper quality under the conditions specified on the Seller's Website.

6.3. In the event of the return of the Goods of inadequate quality (detection of a manufacturing defect), the Seller undertakes, at the Buyer's choice, to exchange the Goods, eliminate the defects or refund the money paid.

6.4. The Buyer shall bear the costs of shipping/delivery of the Goods when returning or exchanging them of adequate quality.

7. RESPONSIBILITY OF THE PARTIES

7.1. The Parties shall be liable for failure to fulfill or improper fulfillment of the terms of this Agreement in accordance with the current legislation of Ukraine.

7.2. The Seller shall not be liable for minor differences in the color scheme and design of the Goods from the images presented on the Site, if these differences do not affect the main characteristics of the Goods.

7.3. The Seller shall be exempt from liability for partial or complete failure to fulfill obligations if this failure is a consequence of force majeure.

8. TERM OF THE AGREEMENT

8.1. The Agreement shall enter into force from the moment of Acceptance by the Buyer of this Offer and shall be valid until the Parties fully fulfill their obligations.
